You will not receive a prize, unless and until your eligibility has been verified and you have been notified that verification is complete. Sponsor assumes no responsibility for any computer, mobile device, PINK Nation App, cable network, algorithm, electronic or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt, or jumbled transmissions; nor service provider, Internet, mobile device, APP, Web site, user accessibility, unavailability, hardware/software incompatibility, traffic congestion, or unauthorized human intervention or any technical or human error; nor the incorrect or inaccurate capture of a Promotion Entry or other information; nor for the failure to capture any such information.
5. Entry Requirements: Ineligible Entries include Entries that fail to comply with these Terms and Conditions, as well as those that are, in whole or in part, potentially violative of a third party’s intellectual property rights, threatening, abusive, harassing, defamatory, libelous, hateful, embarrassing to another person or entity, deceptive, obscene, invasive of another's privacy, tortious, contain racial slurs, or contain explicit or graphic descriptions or accounts of sexual acts, or are not within the spirit of the Promotion, as determined by Sponsor in Sponsor’s sole discretion (the “Entry Requirements”).
6. Winner Selection:
Grand Prize Winners: Ten (10) grand prize winners will be selected on or about June 1, 2020. Entries will be judged via the following two-round judging process using the following criteria when awarding the grand prize:
After the second round of grand prize judging is complete, the top (3) Entries from each Subject and the one (1) Entry selected out of all 60 first round winning Entries (for a total of 10 Entries) will be deemed the potential winners of the grand prize in the Promotion.
Terms Applicable to All Winners: Sponsor is solely responsible for decisions as to the administration and operation of the Promotion, which decisions are final and binding. Potential winners will be notified by email and must respond to such notification within seventy-two (72) hours after being notified, after which his/her prize will be forfeited and the next highest scoring Entry from that Subject that was not already identified as a potential winner will be deemed an alternate potential winner. Except where prohibited, the potential prize winner may be required to submit to and pass a background and publicity check, and, within seventy-two (72) hours after being notified that they are a potential winner, potential winner may be required to provide a photocopy of her driver’s license or other acceptable government issued identification to verify age and provide all other information necessary to complete a background and publicity check. Return of any prize/prize notification as undeliverable, or lack of response by a potential winner, or a potential winner’s noncompliance with these Terms and Conditions may result in disqualification and selection of an alternate potential winner(s). Receiving a prize(s) is contingent upon compliance with these Terms and Conditions. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize(s) to the next highest scoring Entry from that Subject that was not already identified as a potential winner. In the event that Sponsor is unable to award all of the prizes (whether in total or by Subject) after vetting the individuals with the top sixty (60) scoring Entries, the unawarded prizes will be forfeited, will not be awarded and Sponsor shall have no further liability in connection with this Promotion. If an inadequate number of qualified Entries are received (whether in total or by Subject) to award the prizes or if Sponsor cannot verify enough eligible winners to award all prizes after vetting the top sixty (60) scoring Entries, Sponsor reserves the right to award fewer than the number of prizes stated above. POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. 7. Prize/Prize Restrictions:
Grand Prize: Ten (10) grand prizes will be awarded. Each grand prize will consist of a thirty-two thousand five hundred-dollar ($32,500.00 USD) check made out to the winner (twenty-five thousand dollars ($25,000.00 USD) of which is intended to help fund the winner’s project and seven thousand five hundred dollars ($7,500.00 USD) of which is intended to help defray expense associated with the winner’s receipt of the grand prize). Total ARV of each grand prize is $32,500.00. Total ARV for all grand prizes is $325,000.00.
Only the stated number of prizes in these Terms and Conditions will be awarded. All taxes, expenses and other costs not expressly stated in the prize description above are the responsibility solely of winner. Restrictions, conditions and limitations may apply. No transfer, assignment or substitution of a prize (or portion thereof) will be permitted, except by Sponsor, at its sole discretion, due to prize unavailability or other causes otherwise determined solely by Sponsor, and then only for a prize (or applicable portion) of equal or greater value. Sponsor reserves the right to substitute a prize for equal or greater value if the designated prize should become unavailable for any reason. All costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes and other miscellaneous expenses are the winner’s sole responsibility.
8. Publicity: Except where prohibited, participation in the Promotion constitutes consent by winner to Sponsor’s and its agents’ perpetual use of winner’s name, hometown, state, likeness, photograph, voice, opinions and/or Entry submission (including, but not limited to, the video submitted as part of your Entry and your project description) (collectively, the “Attributes”) for promotional purposes in any and all media now known or hereafter devised, worldwide, without further payment or consideration. 9. General Conditions: Sponsor reserves the right to modify the Promotion to add additional prizes. Sponsor reserves the right to cancel, terminate, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, virus, bugs, human error or any other factor beyond Sponsor’s reasonable control impairs the integrity, availability, fairness or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to judge the eligible Entries received up to the time of the impairment and award the prizes to the top scoring Entries in that group of Entries, in addition to other contingencies or measures which Sponsor may implement within its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it suspects or finds: (i) to be tampering with the Entry process or the operation of the Promotion; (ii) to be acting in violation of the Terms and Conditions of this or any other contest, sweepstakes or promotion; (iii) to be acting in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten or harass any other person or entity; (iv) to have used a software generated, robotic, programmed, script, macro or other automated entry; (v) to display behavior that will bring such winner or Sponsor into disgrace; or (vi) to have provided inaccurate information on any documents submitted in connection with the Promotion. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
10. Limitations of Liability and Release: Sponsor, together with its affiliates and related companies, including, without limitation, its parent, sister, and subsidiary companies, retailers, franchisees, advertising and promotions agencies, suppliers of materials and services related to the Promotion, and any other corporation, partnership, sole proprietorship or other legal entity directly involved with the Promotion and their respective officers, directors, employees, agents and other representatives are not responsible for: (1) lost, late, inaccurate, incorrect, stolen, deleted, misdirected, undeliverable or incomplete Entries due to system errors or failures or faulty transmissions or other telecommunications malfunctions; and/or Entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system/human errors and failures, or faulty transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, cable connections, or satellite transmissions, computer online systems, servers or providers, computer equipment, or Entries not received by Sponsor on account of technical problems or traffic congestion on the Internet or at a website, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an entrant’s ability to participate (Proof of transmission does not constitute proof of entry); (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, websites, network hardware or software beyond the reasonable control of Sponsor; (3) unauthorized human intervention in any part of the Entry process or the Promotion; or (4) technical or human error which may occur in the administration of the Promotion or the processing of Entries.
Additionally, in consideration of a winner’s acceptance of the prize, all winners agree to release Sponsor, and its parent, affiliates and agents, from any and all claims, injury or damage arising out of or relating to participation in the Promotion and/or fulfillment and use or misuse of the prize. 11. BINDING ARBITRATION: BY AGREEING TO ARBITRATION, PARTICIPANT UNDERSTANDS AND AGREES THAT THEY ARE WAIVING THEIR RIGHT TO SUE IN COURT. PARTICIPANT AGREES THAT: (I) ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE PROMOTION, OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY -- WITHOUT RESORT TO ANY FORM OF CLASS ACTION -- BY BINDING ARBITRATION (BY A SINGLE NEUTRAL ARBITRATOR SELECTED BY SPONSOR IN ITS SOLE AND ABSOLUTE DISCRETION) ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES AND THE SUPPLEMENTARY PROCEDURES FOR CONSUMER RELATED DISPUTES (THE “AAA RULES”) THEN IN EFFECT; (II) ANY ARBITRATION SHALL BE HEARD BY ONE ARBITRATOR TO BE SELECTED IN ACCORDANCE WITH THE AAA RULES, IN COLUMBUS, OH; (III) UNLESS BOTH PARTICIPANT AND SPONSOR AGREE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING; AND (IV) JUDGMENT UPON ANY AWARD RENDERED MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.

Return of any prize/prize notification as undeliverable, or lack of response by a potential winner, or a potential winner’s noncompliance with these Terms and Conditions may result in disqualification and selection of an alternate potential winner(s). Receiving a prize(s) is contingent upon compliance with these Terms and Conditions. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize(s) to the next highest scoring Entry from that Subject that was not already identified as a potential winner. In the event that Sponsor is unable to award all of the prizes (whether in total or by Subject) after vetting the individuals with the top sixty (60) scoring Entries, the unawarded prizes will be forfeited, will not be awarded and Sponsor shall have no further liability in connection with this Promotion. If an inadequate number of qualified Entries are received (whether in total or by Subject) to award the prizes or if Sponsor cannot verify enough eligible winners to award all prizes after vetting the top sixty (60) scoring Entries, Sponsor reserves the right to award fewer than the number of prizes stated above. POTENTIAL WINNER IS SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. AN ENTRANT IS NOT A WINNER OF ANY PRIZE, EVEN IF THE PROMOTION SHOULD SO INDICATE, UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF ENTRY OR WINNING IN LIEU OF ITS VALIDATION PROCESS.
7. Prize/Prize Restrictions:
Grand Prize: Ten (10) grand prizes will be awarded. Each grand prize will consist of a thirty-two thousand five hundred-dollar ($32,500.00 USD) check made out to the winner (twenty-five thousand dollars ($25,000.00 USD) of which is intended to help fund the winner’s project and seven thousand five hundred dollars ($7,500.00 USD) of which is intended to help defray expense associated with the winner’s receipt of the grand prize). Total ARV of each grand prize is $32,500.00. Total ARV for all grand prizes is $325,000.00.
Only the stated number of prizes in these Terms and Conditions will be awarded. All taxes, expenses and other costs not expressly stated in the prize description above are the responsibility solely of winner. Restrictions, conditions and limitations may apply. No transfer, assignment or substitution of a prize (or portion thereof) will be permitted, except by Sponsor, at its sole discretion, due to prize unavailability or other causes otherwise determined solely by Sponsor, and then only for a prize (or applicable portion) of equal or greater value. Sponsor reserves the right to substitute a prize for equal or greater value if the designated prize should become unavailable for any reason. All costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes and other miscellaneous expenses are the winner’s sole responsibility.
8. Publicity: Except where prohibited, participation in the Promotion constitutes consent by winner to Sponsor’s and its agents’ perpetual use of winner’s name, hometown, state, likeness, photograph, voice, opinions and/or Entry submission (including, but not limited to, the video submitted as part of your Entry and your project description) (collectively, the “Attributes”) for promotional purposes in any and all media now known or hereafter devised, worldwide, without further payment or consideration. 9. General Conditions: Sponsor reserves the right to modify the Promotion to add additional prizes. Sponsor reserves the right to cancel, terminate, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures, virus, bugs, human error or any other factor beyond Sponsor’s reasonable control impairs the integrity, availability, fairness or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to judge the eligible Entries received up to the time of the impairment and award the prizes to the top scoring Entries in that group of Entries, in addition to other contingencies or measures which Sponsor may implement within its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it suspects or finds: (i) to be tampering with the Entry process or the operation of the Promotion; (ii) to be acting in violation of the Terms and Conditions of this or any other contest, sweepstakes or promotion; (iii) to be acting in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten or harass any other person or entity; (iv) to have used a software generated, robotic, programmed, script, macro or other automated entry; (v) to display behavior that will bring such winner or Sponsor into disgrace; or (vi) to have provided inaccurate information on any documents submitted in connection with the Promotion. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
10. Limitations of Liability and Release: Sponsor, together with its affiliates and related companies, including, without limitation, its parent, sister, and subsidiary companies, retailers, franchisees, advertising and promotions agencies, suppliers of materials and services related to the Promotion, and any other corporation, partnership, sole proprietorship or other legal entity directly involved with the Promotion and their respective officers, directors, employees, agents and other representatives are not responsible for: (1) lost, late, inaccurate, incorrect, stolen, deleted, misdirected, undeliverable or incomplete Entries due to system errors or failures or faulty transmissions or other telecommunications malfunctions; and/or Entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, typographical or system/human errors and failures, or faulty transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, cable connections, or satellite transmissions, computer online systems, servers or providers, computer equipment, or Entries not received by Sponsor on account of technical problems or traffic congestion on the Internet or at a website, or any combination thereof, including other telecommunication, cable, digital or satellite malfunctions which may limit an entrant’s ability to participate (Proof of transmission does not constitute proof of entry); (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines, websites, network hardware or software beyond the reasonable control of Sponsor; (3) unauthorized human intervention in any part of the Entry process or the Promotion; or (4) technical or human error which may occur in the administration of the Promotion or the processing of Entries.
Additionally, in consideration of a winner’s acceptance of the prize, all winners agree to release Sponsor, and its parent, affiliates and agents, from any and all claims, injury or damage arising out of or relating to participation in the Promotion and/or fulfillment and use or misuse of the prize. (NEW JERSEY NOTICE: In New Jersey, this release does not apply to liability due to intentional or reckless conduct, gross negligence, strict liability, negligence, or violation of a statutorily imposed duty on the part of Sponsor, or its parent, affiliates and agents).
11. BINDING ARBITRATION: BY AGREEING TO ARBITRATION, PARTICIPANT UNDERSTANDS AND AGREES THAT THEY ARE WAIVING THEIR RIGHT TO SUE IN COURT. PARTICIPANT AGREES THAT: (I) ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE PROMOTION, OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY -- WITHOUT RESORT TO ANY FORM OF CLASS ACTION -- BY BINDING ARBITRATION (BY A SINGLE NEUTRAL ARBITRATOR SELECTED BY SPONSOR IN ITS SOLE AND ABSOLUTE DISCRETION) ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH THE COMMERCIAL ARBITRATION RULES AND THE SUPPLEMENTARY PROCEDURES FOR CONSUMER RELATED DISPUTES (THE “AAA RULES”) THEN IN EFFECT; (II) ANY ARBITRATION SHALL BE HEARD BY ONE ARBITRATOR TO BE SELECTED IN ACCORDANCE WITH THE AAA RULES, IN COLUMBUS, OH; (III) UNLESS BOTH PARTICIPANT AND SPONSOR AGREE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING; AND (IV) JUDGMENT UPON ANY AWARD RENDERED MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF.
12. Participant’s Personal Information: Information collected from participants is subject to the Sponsor’s Privacy Policy, which is available at: https://www.victoriassecret.com/privacy-and-security/. By participating in the Promotion, entrants hereby agree to Sponsor’s collection and usage of their personal information in accordance with Sponsor’s privacy policy and acknowledge that they have read and accepted Sponsor’s privacy policy.
